Many homeowners behind on house payments are being harassed by banks. They keep calling struggling homeowners day and night adding into their stressed lives. Banks believe the more they call behind-on-payments homeowners the more will be the chances of getting paid. But the reality is the banks can’t get any money if the homeowners don’t have it. FDCPA, 15 U.S.C. 1692-1692p, Per Subsection 805 sub section (c) Ceasing Communication states: “If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collection SHALL NOT COMMUNICATE FUTHER with the consumer”

The key is to make sure the notification is done properly; the bank knows who to communicate with and the notification was done officially with a confirmation receipt. This legally stops banks from calling homeowners anymore. This Federal Law was enacted to help consumers preventing harassing-calls by creditors. Banks can’t violate a Federal Law and are liable for the consequences for breaking it.
